Topanga Days Purchase Terms & Conditions

The purchaser/holder of this ticket/these tickets (“I”) desires to participate in the 2024 event Topanga Days (the “Activities”) provided by volunteers of the Topanga Community Club, Inc. DBA Topanga Community Center (“TCC”). As the purchaser/holder of this ticket/these tickets, I agree to all the terms and conditions outlined in this agreement.

Ticketing Terms: 

TCC members are eligible for 1 ticket per member.

Tickets are non-refundable. This is a rain or shine event. In the case of foul weather or inclement conditions, Acts of God, or other reasons the Activities cannot be executed as planned, management reserves the right to postpone or cancel, reschedule, or modify the event.

As this is a non-profit fundraiser, there are no refunds. All monies collected are used to develop and produce the event. TCC pledges to make every effort to produce the fair, and create a safe and exciting event for all. We will do everything possible to prevent any changes to the plans for the Activities.

In the case of a change or cancellation due to factors beyond our control, we are unable to offer refunds.

Liability Release:

I understand the terms and conditions upon entering the TCC grounds and I will abide by the rules and guidelines of the TCC and the Activities. I am responsible for the well-being of myself and those in my family/ party, my property, and my vehicle, if applicable. I understand that compliance with the safety rules will be enforced and guests who do not follow them will be escorted out of the event without a refund. I acknowledge that I am knowingly and voluntarily participating in the Activities with an express understanding of the danger involved and hereby agree to accept and assume any and all risks of injury, death, or property damage, whether caused by the ordinary negligence of the TCC or otherwise.

I expressly waive and release any and all claims which I may have, or which I may hereafter have, whether known or unknown, against the TCC, its officers, agents volunteers, successors, vendors, and assigns collectively, “Releasees” on account of injury, death, or property damage arising out of or attributable to my participation in the Activities, whether arising out of the ordinary negligence of the TCC or any Releasees or otherwise.

I agree not to make or bring any such claim against the TCC or officers or volunteers or any other Releasee, and forever release and discharge the TCC from liability under such claims. This waiver and release do not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be released by agreement.

I understand that by purchasing this ticket/these tickets, I am waiving any and all claims, of any kind arising out of or attributable to my participation in the Activities, including those claims that may be unknown to me, or which I do not suspect to exist at this time. By making this purchase, I acknowledge that I have read and fully understood all of the terms of this agreement and that I am voluntarily giving up substantial legal rights, including the right to sue the TCC or tap or officers for claims, whether known or unknown, arising out of my participation in the Activities.

COVID-19 safety warning and protocols: 

TCC and officers, volunteers and agents have taken enhanced safety and health measures to do our part in minimizing the exposure of our guests to COVID-19. All TCC guests are expected to follow all posted instructions and directions from security and safety personnel on TCC grounds. Despite these safety measures, there is a risk of exposure to COVID-19 at this event. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention (CDC), senior citizens and guests with underlying medical conditions are especially vulnerable.

By making this ticket purchase, I, the Participant, acknowledge that I have carefully reviewed and agree to the terms outlined above, including those related to COVID-19 safety, and willingly assume all risks related to my voluntary participation in the Activities.

Fun Zone Acknowledgement and Release: 

As part of the Activities at Topanga Days, I acknowledge that participation in the Fun Zone, which includes bounce houses and other recreational activities, is entirely at my own risk. I understand that while TCC takes reasonable measures to ensure the safety and proper operation of the Fun Zone equipment, the nature of such activities is inherently risky and may result in injury.

I hereby assume all risks associated with participating in the Fun Zone activities, including but not limited to falls, contact with other participants, and interaction with the equipment, acknowledging that these risks may lead to physical injury or other damages. I understand that these risks may be magnified due to negligence on the part of other participants or unforeseen accidents.

I agree to release, indemnify, and hold harmless the TCC, its officers, volunteers, agents, and any other individuals or entities associated with the Fun Zone, from any and all claims, demands, losses, damages, liabilities, lawsuits, and/or causes of action, which arise out of or relate to any injury, illness, loss, or harm to me or my property in connection with my voluntary participation in the Fun Zone activities, whether such injury or harm is the result of negligence by the TCC, another participant, or the result of the inherent risks of the activity itself.

This release extends to any claim that might arise after the conclusion of the Activities, whether currently anticipated or unforeseen. I agree that this release shall be binding upon me, my heirs, executors, administrators, and assigns. By purchasing this ticket/these tickets, I acknowledge that I have carefully read this “FUN ZONE ACKNOWLEDGEMENT AND RELEASE” and fully understand its contents. I am aware that this is a release of liability and an assumption of risk agreement and that it is a legally binding agreement between myself and the TCC.

I voluntarily agree to each statement as provided in this waiver and release.

Identification of Parties and Date of Agreement: 

This agreement is entered into by the undersigned (“Participant”) and the Topanga Community Club, Inc. DBA Topanga Community Center (“TCC”) on the date of the ticket purchase. The Participant, as the purchaser/holder of this ticket/these tickets, wishes to engage in the Activities provided during the Topanga Days event.

Minor Participants:

If the Participant is under the age of 18, a parent or legal guardian must agree to these terms and conditions on their behalf and assumes all risks associated with the minor’s participation in the Activities.

Dispute Resolution:

Any disputes arising from this agreement shall be resolved in accordance with the laws of the State of California and, where applicable, through final and binding arbitration in the jurisdiction where the TCC is located.

Photography/Video Release:

The Participant hereby grants TCC the irrevocable right to use their image, likeness, or voice in any photographic or audio recording taken during the Activities, without compensation or acknowledgement, for any lawful purpose.

Accessibility and Accommodations:

TCC is committed to providing an inclusive experience for all participants. Please contact the TCC for any specific accessibility requirements or accommodations.

Rules and Conduct:

The Participant agrees to abide by all rules and conduct guidelines posted by TCC during the event. Failure to follow these guidelines may result in ejection from the event without a refund.

Amendments:

This agreement may only be amended in writing and signed by both the Participant and an authorized representative of TCC.

Acknowledgment of Physical Fitness:

The Participant attests to being physically fit and able to engage in the Activities and acknowledges that they have been advised to seek medical advice if they are aware of any health conditions that might affect their participation.

Emergency Medical Care:

In the event of a medical emergency, TCC is authorized to provide or seek emergency medical care for the Participant. The Participant agrees to be financially responsible for any costs incurred as a result of such treatment.

Acknowledgment of Understanding:

The Participant confirms that they have read this agreement in its entirety and fully understands its contents and implications, including the relinquishment of legal rights contained herein.

Signature Requirement:

By completing the ticket purchase, the Participant affirms that this electronic transaction shall constitute their signature, and thereby they consent to all terms and conditions as if they had physically signed this agreement.
