Topanga Days Purchase Terms & Conditions

To participate in the 2025 Topanga Days festival (the “Event”), provided by the Topanga Community Club, Inc. DBA Topanga Community Center (“TCC”) , the purchaser/holder of any Event tickets (the “Participant”) agrees to all terms and conditions outlined in this agreement .

Identification of Parties and Date of Agreement: 

This agreement is entered into by the undersigned (“Participant”) and the Topanga Community Club, Inc. DBA Topanga Community Center (“TCC”) on the date of the ticket purchase. The Participant, as the purchaser/holder of this ticket/these tickets, wishes to engage in the activities of the Event Topanga Days.

Ticketing Terms: 

• TCC Members: Each TCC member is eligible for one (1) discounted member-priced ticket per member.
• Non-Refundable: Tickets are non-refundable, regardless of weather conditions, Acts of God, unforeseen circumstances, or event modifications.
• Event Modifications: The Event is a rain-or-shine fundraiser. In case of inclement weather, safety concerns, or factors beyond TCC’s control, TCC reserves the right to modify, reschedule, or cancel the Event without refund.

Health & Safety Disclaimer: 

TCC prioritizes guest safety but cannot eliminate all risks associated with public gatherings. By attending the Event, the Participant acknowledges the inherent risks of illness or injury and voluntarily assume responsibility for my well-being.

Liability Release:

The Participant understands the terms and conditions upon entering the TCC grounds and will abide by the rules and guidelines of the TCC and the Event. the Participant is responsible for the well-being of themselves and those in their family/party, property, and vehicle, if applicable. The Participant understands that compliance with the safety rules will be enforced and Participants who do not follow them will be escorted out of the event without a refund. The Participant acknowledges that they are knowingly and voluntarily engaing in the Event with an express understanding of the danger involved and hereby agrees to accept and assume any and all risks of injury, death, or property damage, whether caused by the ordinary negligence of the TCC or otherwise.

The Participant expressly waives and releases any and all claims which they may have, or which they may hereafter have, whether known or unknown, against the TCC, its officers, agents, volunteers, successors, vendors, and assigns collectively, “Releasees” on account of injury, death, or property damage arising out of or attributable to their participation in the Event, whether arising out of the ordinary negligence of the TCC or any Releasees or otherwise.

The Participant agrees not to make or bring any such claim against the TCC or any of the  Releasees, and forever release and discharge the TCC from liability under such claims. This waiver and release do not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be released by agreement.

The Participant understands that by purchasing this ticket/these tickets, they are waiving any and all claims, of any kind arising out of or attributable to their participation in the Event, including those claims that may be unknown to them, or which they do not suspect to exist at this time. By making this purchase, they acknowledge that they have read and fully understood all of the terms of this agreement and that they are voluntarily giving up substantial legal rights, including the right to sue the TCC or tap or officers for claims, whether known or unknown, arising out of their participation in the Event.

Fun Zone Acknowledgement and Release: 

The Participant acknowledges that participation in the Fun Zone, which includes bounce houses and other recreational activities, is entirely at their own risk. They understand that while TCC takes reasonable measures to ensure the safety and proper operation of the Fun Zone equipment, the nature of such activities is inherently risky and may result in injury.

The Participant hereby assumes all risks associated with engaging in the Fun Zone activities, including but not limited to falls, contact with other participants, and interaction with the equipment, acknowledging that these risks may lead to physical injury or other damages. The Participant understands that these risks may be magnified due to negligence on the part of other participants or unforeseen accidents.

The Participant agrees to release, indemnify, and hold harmless the TCC, its officers, volunteers, agents, and any other individuals or entities associated with the Fun Zone, from any and all claims, demands, losses, damages, liabilities, lawsuits, and/or causes of action, which arise out of or relate to any injury, illness, loss, or harm to them or their property in connection with their voluntary participation in the Fun Zone activities, whether such injury or harm is the result of negligence by the TCC, another participant, or the result of the inherent risks of the activity itself.

This release extends to any claim that might arise after the conclusion of the said Fun Zone activities, whether currently anticipated or unforeseen. The Participant agrees that this release shall be binding upon them, their heirs, executors, administrators, and assigns. By purchasing this ticket/these tickets, the Participant acknowledges that they have carefully read this “FUN ZONE ACKNOWLEDGEMENT AND RELEASE” and fully understand its contents. The Participant is aware that this is a release of liability and an assumption of risk agreement and that it is a legally binding agreement between themselves and the TCC.

The Participant voluntarily agree to each statement as provided in this waiver and release.

Minor Participants:

If the Participant is under the age of 18, a parent or legal guardian must agree to these terms and conditions on their behalf and assumes all risks associated with the minor’s participation in the Event.

Dispute Resolution:

Any disputes arising from this agreement shall be resolved in accordance with the laws of the State of California and, where applicable, through final and binding arbitration in the jurisdiction where the TCC is located.

Photography/Video Release:

The Participant hereby grants TCC the irrevocable right to use their image, likeness, or voice in any photographic or audio recording taken during the Event, without compensation or acknowledgement, for any lawful purpose.

Accessibility and Accommodations:

TCC is committed to providing an inclusive experience for all participants. Please contact the TCC for any specific accessibility requirements or accommodations.

Acknowledgment of Physical Fitness:

The Participant attests to being physically fit and able to engage in the Event and acknowledges that they have been advised to seek medical advice if they are aware of any health conditions that might affect their participation.

Emergency Medical Care:

In the event of a medical emergency, TCC is authorized to provide or seek emergency medical care for the Participant. The Participant agrees to be financially responsible for any costs incurred as a result of such treatment.

Acknowledgment of Understanding:

The Participant confirms that they have read this agreement in its entirety and fully understands its contents and implications, including the relinquishment of legal rights contained herein.

Signature Requirement:

By completing the ticket purchase, the Participant affirms that this electronic transaction shall constitute their signature, and thereby they consent to all terms and conditions as if they had physically signed this agreement.
